What the law requires in Portugal in 2026 (DL 84/2021)
Much of what you read online about used-car warranties in Portugal still quotes the old law (DL 67/2003): "two years, or one year on used cars". That stopped being true in 2022. The current regime for consumer sales of movable goods is:

There is one more detail that almost nobody explains and that decides complaints: the burden of proof. For the first two years (or the first 12 months on used goods), the defect is presumed to have existed at delivery — the seller has to prove otherwise. After that, the burden shifts to you. In practice a failure at 10 months and the same failure at 20 months are completely different legal conversations.
Note what this means: when a dealer advertises "18-month warranty" on a used car, that is not a generous extra — it is the legal floor, agreed with you in writing. The right question is not "does it have a warranty?" but "is it three years or the reduced 18 months, and where is that written?".
Imported cars: who is actually liable
Here is the part that matters if you are importing. The warranty is not defined by where the car came from — it is defined by who sells it to you:
- Buying from a Portuguese dealer (even if the car came from Germany): Portuguese law applies, the invoice is Portuguese, and the address and tax number you would complain to are in Portugal. You also have the Livro de Reclamações and consumer arbitration centres.
- Buying directly from a foreign seller and importing yourself: the consumer relationship is with that seller and is generally governed by their country's law. You still have rights — but exercising them means complaining in another language, another system, possibly another court.
- Buying from a private seller, here or abroad: no legal warranty. Whatever exists must be in the contract.
Separate from the legal warranty there is the manufacturer warranty. For mainstream European brands the factory warranty is normally valid across the European network and transfers with the car to the new owner — useful on a two or three-year-old import. Two cautions: the clock runs from the first registration, not the Portuguese one, and servicing must have followed the manufacturer's schedule. Ask for the VIN and confirm the remaining cover with a brand dealer in Portugal before you buy, not after.
What to ask before buying an imported car with a warranty
- Who is the seller on the invoice? Name, tax number, address. That is the entity you would claim against — not the intermediary who answered the phone.
- How many months of warranty are written down? If it says 18, there must be a written reduction agreement. If nothing is written, the period is three years.
- What is excluded? Wear items (pads, discs, tyres, clutch, battery) are normally out. That is legitimate — as long as it is clear beforehand.
- How do you claim? Which garage, who pays transport, response time, courtesy car. A warranty that requires a 400 km trip is worth less.
- Is there factory warranty left? Confirm by VIN, using the first registration date.
- Is legalisation complete? Portuguese plates issued, ISV settled, and annual IUC already in your name. An "almost legalised" car is not a car with a warranty — it is an open process.
A warranty is not a substitute for an inspection
